Athalon Terms of Service

Welcome to Athalon, a fitness application designed to help you track, analyze, and share your fitness activities. These Terms of Service ("Terms") govern your use of the Athalon mobile application, website, and related services (collectively, the "Services") provided by Athalon, Inc., headquartered in San Francisco, California, USA. By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

1. Acceptance of Terms

By registering for or using the Services, you confirm that you are at least 13 years old (or the minimum age required in your country) and agree to comply with these Terms, including our Acceptable Use Policy, and any supplemental terms provided through the Services.

2. Account Registration

• Eligibility: You must be at least 13 years old or meet the minimum age requirement in your country to create an account. If you are under 18, you may need parental consent to use certain features.
• User Data: You agree to provide accurate, current, and complete information during registration ("User Data") and to keep it updated. Athalon may use your User Data to provide the Services as outlined in these Terms and our Privacy Policy.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to create only one account for personal use and not share your account or subscription with others.
• Account Suspension: Athalon reserves the right to suspend or terminate your account if you provide inaccurate information, create multiple accounts, or violate these Terms.

3. Use of Services

You may use the Services to track fitness activities, set goals, join challenges, and interact with other users (e.g., through likes or comments), subject to your privacy settings. You agree to comply with our Acceptable Use Policy, which prohibits content or conduct that is:

• Illegal, fraudulent, or harmful.
• In violation of others’ rights, including intellectual property rights.
• Offensive, such as hate speech, harassment, or explicit content.
• Disruptive, such as spam or automated posting.

Athalon reserves the right to review user actions and content to ensure compliance with these Terms and may suspend or terminate accounts for violations.

4. Content Ownership and License

• Your Content: You retain ownership of the content you create or upload (e.g., activity data, photos, comments, likes). By uploading content, you grant Athalon a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute your content to provide the Services, such as displaying your activities on leaderboards or generating personal heatmaps, subject to your privacy controls.
• Athalon Content: All content provided by Athalon, including software, designs, and trademarks, is owned by Athalon or its licensors. You may not reproduce, modify, or distribute Athalon content without permission.

5. Privacy and Data

We are committed to protecting your privacy. We do not sell your personal information or share sensitive data (e.g., precise location, health data) with third parties without your express consent. Please review our Privacy Policy for details on how we collect, use, and protect your information.

You may share your activities or profile data with third-party apps or services integrated with Athalon, but such sharing is subject to those third parties’ terms and policies.

6. Payments and Subscriptions

• Some features require a paid subscription. You must provide a valid payment method (e.g., credit card or third-party payment service) to access these features.
• Subscriptions may auto-renew unless canceled. You can cancel your subscription at any time through your account settings. No refunds are provided for partial subscription periods.

7. Third-Party Integrations

You may connect your Athalon account to third-party services (e.g., fitness trackers, social media). By doing so, you agree to comply with those third parties’ terms and policies. Athalon is not responsible for the practices or policies of third-party services.

8. Termination

You may delete your account at any time, which will permanently remove your personal data from our systems, except for aggregated or de-identified data used for community features (e.g., heatmaps). Athalon may terminate or suspend your account for violations of these Terms, fraudulent activity, or legal requirements.

9. No Warranties and Limitation of Liability

The Services are provided "as is" without warranties of any kind, express or implied. Athalon does not guarantee the accuracy, reliability, or availability of the Services. Athalon is not liable for any damages arising from your use of the Services, including injuries from activities tracked or shared via the Services.

10. Dispute Resolution

• If you reside outside the European Economic Area, any disputes will be resolved through binding arbitration in San Francisco, California, under the rules of the American Arbitration Association.
• If you reside in the European Economic Area, you may pursue disputes through applicable local legal processes.

11. Modifications to Terms

Athalon may update these Terms at any time. We will notify you of material changes via email or through the Services. Continued use of the Services after such changes constitutes acceptance of the updated Terms.
